2. In this case, the petitioner is seeking regular bail in connection with Barauni P.S. Case No. 563 of 2023, registered for the offences punishable under Sections 341, 323, 379, 504, 376/34 of the Indian Penal Code.

3. As per allegation, the petitioner had physical relation with the informant. He refused to marry her. He also assaulted the informant and snatched her ornaments.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. As a matter of fact, the informant is a lady of questioning chastity. She has already lodged cases against a number of

Patna High Court CR. MISC. No.24473 of 2024(4) dt.10-07-2024 2/2 innocent persons. It transpires from paragraph no. 37 of the case diary that she had lodged a similar type of case against one Md. Mansoor and in that case she had compromised. Further submission of the learned counsel is that only with a view to extort money, she has lodged the present case. Learned counsel has also submitted that the informant is a married lady and she has children from her marital life.

5. On the other hand, learned counsel for the informant has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S. Case No. 563 of 2023, subject to the following condition:- The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
