The petitioner seeks bail in a case instituted for the offences under Sections 302 and 201/34 of the I.P.C. Allegation is that the informant's son, namely, Dipu Nath Tiwary was murdered and his dead body was thrown in a Nala. The informant has suspected that the F.I.R. named accused persons has committed the murder of her son.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 19.5.2016 and the charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is not

Patna High Court Cr.Misc. No.35207 of 2016 (3) dt.21-10-2016 2/2 named in the F.I.R. Merely on the confession of co-accused he has been made accused in the present case.

On behalf of the State and the learned counsel for the informant, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of Shri R.N. Tripathy, Judicial Magistrate, 1st class 8th, Patna in connection with Kotwali P.S. case No.148 of 2016.
