Learned counsel are appearing and making submissions from their residence. The Court master and Secretary are also part of this virtual Court proceedings with the aid of audio visual technology.

Heard learned counsel for the petitioners and learned APP for the State .

The petitioners seek bail in Naubatpur P.S. Case no. 100 of 1999 instituted for the offence under Sections 302/34 of the IPC,1860 .

Patna High Court CR. MISC. No.18169 of 2020(7) dt.06-10-2020 2/3 The prosecution case alleges that the petitioner no.1 has taken the informant's brother along with him on the pretext that petitioner no.2 was calling him. It is alleged that thereafter he has been beaten to death.

It is submitted by the petitioners' counsel that the allegation of assault is attributed against co-accused, namely, Talu Ravidas, including petitioners and others. The said Talu Ravidas has been allowed bail in Cr. Misc. No. 21149 of 2020. The petitioners having no criminal antecedents and have now been in custody for about one year, i.e. since 26.10.2019. The learned APP has opposed the prayer for bail by submitting that the petitioners participated in the occurrence. Considering the aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of the ACJM II Danapur Patna in connection with Naubatpur P.S. Case No. 100 of 1999 subject to the following conditions:- (i) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the

(ii) That the petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail bond will be liable to be cancelled.
