JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 13-10-2017 Heard learned counsel for the petitioner, learned counsel appearing on behalf of O.P. No.2 and the learned A.P.P. for the State. The petitioner apprehends his arrest in connection with Complaint Case No. 2910 (C) of 2015, registered under Sections 323, 369, 498(A) and 504 of the Indian Penal Code. Learned counsel for the petitioner and O.P.No.2 submits that on the joint prayer of the parties, the matter was referred to Mediation Centre, Patna High Court, Patna for mediation and settlement of dispute in between the petitioner and O.P. No.2, who are husband and wife, where both the parties have decided to live separately by dissolving the marriage on filing the joint petition for divorce and also to withdraw all cases pending between them and they
Patna High Court Cr.Misc. No.11338 of 2017 (5) dt.13-10-2017 2/2 also furnish the written agreement dated 03.10.2017 before the Mediation Centre, Patna High Court, Patna, which is the part of the Mediator's Report dated 11.10.2017.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Patna in connection with Complaint Case No. 2910 (C) of 2015, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
