JUSTICE RAKESH KUMAR ORAL ORDER 08-12-2016 Heard Sri Udit Narayan Singh, learned counsel, assisted by Sri Gajendra Kumar Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 29.06.2016 in Muzaffarpur Sadar P.S. Case No.364/16 registered for the offence under Sections 20,22 of the N.D.P.S. Act, Sections 271, 272 of the Indian Penal Code, and Section 47(A) of the Bihar Excise ( Amendment) Act, 2016, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that the petitioner is a proprietor of restaurant, from where allegedly about 400 gms of Ganja and two bottles containing 375 ml each foreign liquor of Royal Stag were shown
Patna High Court Cr.Misc. No.42563 of 2016 (2) dt.08-12-2016 2/2 to be recovered. Learned counsel for the petitioner, by way of referring to the statement made in paragraph-3 of the petition, submits that the petitioner is having clean antecedent. Learned Addl. Public Prosecutor has opposed the prayer for bail.
However, considering the fact that the alleged recovered Ganja was much lesser than the smaller quantity as well as recovery of foreign liquor, there is no reason to refuse the prayer for bail of the petitioner. Accordingly, let the petitioner, namely, Munna Kumar Singh @ Munna Prasad Singh be released on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, Muzaffarpur in connection with Muzaffarpur Sadar P.S.
