The petitioner seeks bail in Special Case No.7875 of 2018 arising out of Bihta P.S. Case No.968 of 2018 registered for the offence under Sections 30 (a) of Bihar Prohibition of Liquor and Excise Act.

Accusation is of recovery of 50 liter country made liquor from the motor cycle of the petitioner.

Submission on behalf of the petitioner is that the petitioner has no criminal antecedent and he is in custody since 28.8.2018.

Heard the learned A.P.P. also who opposed the prayer for bail of the petitioner.

Considering the facts and circumstances of the case, as

Patna High Court Cr.Misc. No.62396 of 2018 (2) dt.06-10-2018 2/2 stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna, in Special Case No.7875 of 2018 arising out of Bihta P.S. Case No.968/18.
