Learned Counsel for the Opposite Party No. 2 and the Additional Public Prosecutor are present.
This application, for grant of anticipatory bail, arises out of Complaint Case No. 125-C of 2018, in which cognizance has been taken for the offences under Sections 498-A, 384, 323, 504 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act, 1961.
The present matter relates to marital discord between the petitioner and the Opposite Party No. 2 and by order, dated 08.07.2019, the matter was referred to Patna High Court Mediation Centre.
The report of the learned Mediator, dated 15.10.2019,
Patna High Court CR. MISC. No.22524 of 2019(5) dt.18-10-2019 2/2 is on record and from perusal of the same, it is evident that both the parties have settled their disputes amicably. A joint memorandum of agreement, dated 14.10.2019, entered into between the parties is also annexed with the report of the learned Mediator and from perusal of the same, it transpires that both the parties have agreed to withdraw all the cases pending against them and have separated themselves mutually. Having regard to the above, this application is, allowed.
Let the petitioner, Ritesh Baid, in the event of his arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria, in connection with Complaint Case No. 125-C of 2018, subject to the conditions (i) laid down under Section 438 (2) of the Code of Criminal Procedure and (ii) both the parties shall fulfill the terms and conditions entered into between them on 14.10.2019.
