In this case, the petitioner is seeking bail in connection with POCSO Case No. 101 of 2019 arising out of Karakat P.S. Case No. 274 of 2019 registered for offence under Section 376 of the Indian Penal Code and Section 4 & 6 of the POCSO Act.

In the present case, an allegation has been made against the petitioner that he used to visit the house of the victim girl, namely, Prema Kumari, she was enticed by him and assurance was given for marriage and, thereafter, he entered into sexual relationship with her. The process continued for long period and the girl became pregnant.

Patna High Court CR. MISC. No.20557 of 2020(4) dt.15-10-2020 2/2 The age of the victim girl has been shown as 16 years whereas the petitioner was of 19 years old at the time of occurrence.

Looking to the nature of offence as also considering the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner, above named, is rejected for the present.
