2. The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a)/37(c) of Bihar Prohibition and Excise Act.
3. As per F.I.R., 2 bottles of 750 ml., 4 bottles of 375 ml. and one bottle containing 200 ml. of foreign liquor are said to have been recovered from the Dhaba of this petitioner.
4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the conscious possession of petitioners and has been made accused in this case merely because he is owner of the Dhaba. He further submits that petitioner's Dhaba was let out on rent to some other person. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the nature of accusation and clean antecedent, let the above named petitioner, in the event of arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise - I, Samastipur, in connection with Agarghat P.S. Case No. 104 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
