JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 10-10-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier, the prayer for bail of the petitioner was rejected by this Court giving liberty to him to renew his prayer for bail, if his trial is not concluded within six months. The impugned order goes to show that charge against the petitioner was framed on 09.02.2018 and up till now not a single prosecution witness could be examined.
Learned counsel appearing for the petitioner submits that having, more or less, similar allegation some co-accused have already been granted privilege of bail and, moreover, the allegation of assault is general and omnibus. Learned Additional Public Prosecutor for the State
Patna High Court Cr.Misc. No.63561 of 2018 (2) dt.10-10-2018 2/2 opposed the prayer for bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-III, Bhojpur, Ara in connection with Piro P.S.Case No. 322 of 2015, Session trial no. 64 of 2016.
