Petitioner seeks bail in a case registered under section 394 of the Indian Penal Code.
Looted motorcycle is said have been recovered from the possession of the petitioner and taking note of the aforesaid fact, prayer for bail of the petitioner was earlier rejected by this court but the petitioner is in jail custody since 10.9.2015 and the trial court has reported that up till now, only three prosecution witnesses could be examined and the case is pending for hearing on the point of commitment as the prosecution filed a petition before trial court for commitment of the case of the petitioner.
No doubt, petitioner carries criminal antecedent of several cases but taking note of the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on
Patna High Court Cr.Misc. No.35068 of 2016 (3) dt.21-12-2016 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Uda-kishunganj in Uda-kishunganj P.S. Case no. 124/2015 subject to condition that if in future his involvement in similar type of cases is found, learned trial court shall be at liberty to cancel the bail bond of the petitioner.
