ANJANA MISHRA ORAL ORDER 11-12-2018 As prayed for, learned counsel for the petitioner is permitted to make necessary corrections in the prayer portion of the present bail application Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Turkaulia P.S. Case No.289 of 2017 for allegedly having committed the offence under Sections 147, 148, 149, 341, 323, 307, 379 and 504 of the Indian Penal Code.

Learned counsel for the petitioner submits that there is a case and counter case between the parties and the petitioner's side had registered an F.I.R., bearing Turkaulia

Patna High Court Cr.Misc. No.63027 of 2018(2) dt.11-12-2018 2/2 P.S. Case No.286 of 2017. It is further submitted that there were injuries on both sides and the informant of the present case has filed the F.I.R. only as an afterthought making false and frivolous allegations. There is admittedly a land dispute between the parties and the unlawful assembly was to prevent unlawful construction of house on the land of the present petitioner.

Considering the aforementioned facts and circumstances and the petitioner is having a clean antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Turkaulia P.S. Case No.289 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
