JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2019 This is an application for grant of anticipatory bail in connection with Akbarpur P.S. Case No. 273 of 2018, disclosing offences under Sections 147, 448, 341, 323, 325, 379, 307 & 504 of the Indian Penal Code.

Allegation as per F.I.R. against the petitioner is that uncle of the informant and others came and assaulted by Lathi and Rod to his father and specific allegation of assault to father of the informant, causing injury to his eyes is on other coaccused. Specific allegation against the petitioner is of assault by rod to the informant.

Submission of the learned counsel for the petitioner is that so far as allegation of assault against the father is concerned, no specific allegation has been alleged against this petitioner, rather it is alleged against Bhusan Singh. So far as,

Patna High Court CR. MISC. No.18451 of 2019(4) dt.18-06-2019 2/2 allegation against this petitioner is concerned, injuries are found to be simple in nature on the person of the informant. Heard learned A.P.P. also.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Nawada, in connection with Akbarpur P.S. Case No. 273 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
