2. This application, under Section 482 of the Code of Criminal Procedure, is directed against the order dated 02.01.2013 passed in Case No. M684 of 2011 in proceeding, under Section 147 of the Criminal Procedure Code, whereby the Sub-Divisional Magistrate, East Muzaffarpur, directed the second party-petitioner to remove the construction over the passage connecting the house of the applicantopposite party no.2.

3. On going through the impugned order, I find no illegality amounting to abuse of the process of the court for
