The petitioner seeks bail in Ara Nagar P.S. Case No. 491/2018, Excise Case No. 1349/2018, instituted for the offences under Sections 30 and 36 of Bihar Prohibition and Excise Act, 2016.

It is alleged in the written report that police intercepted a tempo and motorcycle. The petitioner was driving the tempo. It is further alleged that 80 litres of country made liquor has been recovered from the tempo and 10 litres of country made liquor has been recovered from Jhola kept on motorcycle. Learned counsel for the petitioner has submitted that petitioner is merely driver of the tempo. He has no concern with

Patna High Court Cr.Misc. No.64502 of 2018 (2) dt.26-10-2018 2/2 aforesaid liquor. He has clean antecedent. He is in custody since 25.08.2018.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (Excise), Bhojpur at Ara in connection with Ara Nagar P.S. Case No. 491/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
