JUSTICE SUDHIR SINGH ORAL ORDER 20-10-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted for the offences under Sections 420, 467, 468 and 471/34 of the I.P.C. Allegation is that the accused persons including the petitioner by preparing forged papers in the name of Sumit Ray demanded rangdari from the informant.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.6.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no substantive evidence to suggest his implication in the present case. The other co-accused has been granted bail vide
Patna High Court Cr.Misc. No.35197 of 2016 (3) dt.20-10-2016 2/2 Cr.Misc.No.33526 of 2016.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. case No.241 of 2016.
