2. The petitioners apprehend their arrest in a case registered for the offence under Sections 420, 379, 411, 120(B) of the Indian Penal Code.

3. Petitioners are owner and driver respectively of a J.C.B. machine, bearing registration no. BR01GH-2611, which was found indulged in illegal mining of Ganga sand.

4. Learned counsel for the petitioners, while denying the prosecution case, submits that petitioner no. 1, who is owner of the J.C.B. machine, has already deposited the amount of Rs. 4,09,585/- (Rupees four lacs nine thousand five hundred eighty

No.22983 of 2024(3) dt.14-05-2024 2/2 five) on 07.05.2024 in the office of Mining Department, Patna and the department, vide letter no. 1583/M dated 07.05.2024 (Annexure 3 to the supplementary affidavit) has already confirmed the same. Petitioners have got clean antecedent.

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - XIII, Patna in connection with Digha P.S. Case No. 900 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
