The petitioner seeks bail in connection with Barauni P.S. Case No.228 of 2016 registered under Section 273 of the Indian Penal Code as well as Section 47A of the Bihar Excise Amendment Act.
It is contended that from perusal of the FIR itself it would appear that nothing has been recovered from possession of the petitioner rather recovery was made from three passengers, who had boarded the tempo of the petitioner and were caught by the police on chase.
Learned counsel for the State has opposed the prayer for grant of bail to the petitioner.

No.35133 of 2016 (2) dt.20-08-2016 2/2 Regard being had to the nature of allegation, the petitioner, namely, Pawan Roy, who is in custody since 14th June, 2016 is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Barauni P.S.
