JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 409 and 420 of the Indian Penal Code. Allegation against the petitioners is that they misappropriated public money.
It has been submitted on behalf of the petitioners that they have got no criminal antecedent. Petitioner no. 1 is the Chairman and petitioner no. 2 is the Executive Committee Member. As per prosecution case, there is a loan amount outstanding of Rs. 3 lacs 22 thousand and odd against the petitioners. From perusal of Annexure-2 series, it would appear that the bank has given a No Dues Certificate to both the petitioners indicating that no loan amount is outstanding, which is dated 8.6.2015, i.e., it has been issued after institution of the present F.I.R.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

No.39728 of 2015 (2) dt.30-09-2015 2 / 2 Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi, in connection with Sitamarhi P.S. Case no. 379 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
