The present application has been filed for modification of the order dated 01.02.2016, passed in Cr. Misc. No. 46808 of 2015, by which the petitioner was granted anticipatory bail in connection with Mushahari P.S. Case No. 64 of 2013, pending in the court of Smt. Anupma Kumari, learned J.M., 1st Class, Muzaffarpur, under Sections 304(B) and 201/34 of the Indian Penal Code and the petitioner was directed to surrender in the court below within a period of six weeks and furnish bail bond. It is submitted on behalf of learned counsel for the petitioner that due to some unavoidable reason the petitioner could not surrender in the court below well within time. It is further prayed that time of surrender may be extended, so that the

Patna High Court Cr.Misc. No.11317 of 2017 (2) dt.15-03-2017 2/2 petitioner could surrender in the court below and furnish bail bond.

Considering the submissions made on behalf of learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the court below is extended for a further period of three weeks from the date of receipt/production of copy of the order. The order dated 01.02.2016 passed in Cr. Misc. No. 46808 of 2015, is modified to the extent as indicated above. The modification application is, accordingly, disposed of.
