The petitioners apprehend their arrest in connection with Motipur P.S. Case No.946 of 2018 registered under Sections 341, 323, 504, 506, 307 and 324/34 of the Indian Penal Code. The accusation is that when Kanchan Kumari, the daughter of the informant Gita Devi, was alone at her house, the petitioners along with their son came at the door of the informant and abused her. When the informant returned to her house, her daughter narrated the entire incident to her. On the next day, when the informant asked them as to why they had abused her daughter, all started to commit "Maar-Peet" with her. At that time, the petitioner no.1 caused blood oozing injury at the head of the informant through

Patna High Court CR. MISC. No.18458 of 2019(6) dt.15-07-2019 2/2 Daab, due to which she fell down on the ground. When the husband of the informant rushed to save her, then they caused injury to him through lathi and danda.

Learned counsel for the petitioners submits that the scuffle took place in between the children of both sides in course of which the informant fell down and sustained injury. Moreover, the injury, as sustained by the informant on her head, is simple in nature. The petitioners have no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, West, Muzaffarpur, in connection with Motipur P.S. Case No.946 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
