The petitioner has preferred this application for grant of regular bail in a case registered under sections 302 and 34 of the Indian Penal Code.

As per the prosecution case, the ten named accused persons including the petitioner are stated to have come and entered into an altercation with the informant and the members of his family. Thereafter it is stated that the petitioner and one Jeetendra Yadav assaulted the informant as also his father with box and his elbow leading to injury to his father who fell down unconscious. On being taken to the hospital, he was declared dead.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations are general and omnibus in nature. The petitioner is

Patna High Court CR. MISC. No.18990 of 2020(3) dt.25-11-2021 2/2 in custody since 6.7.2019 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 2 years, the petitioner is directed to be enlarged on bail in connection with Majhauliya P.S. Case no. 265 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran.
