The petitioner seeks bail in Maker P.S. Case No. 126/15 registered under Section 382 of the Indian Penal Code. It has been submitted on behalf of the petitioner that the petitioner is not named in the F.I.R. and even after that he has not been put on T.I.P. and nothing has been recovered from the possession of the petitioner. It has further been submitted that the petitioner is in custody since 14.09.2016.

Heard learned A.P.P. also. Learned A.P.P. has pointed out that the petitioner is accused in two other cases. Having heard both sides and in view of the fact that except confessional statement of the co-accused, who is the Mukhiya, there is nothing against the petitioner and in view of the

No.54705 of 2016 (2) dt.09-01-2017 2/2 fact that the petitioner has not been put on T.I.P. and he is in custody for about four months, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in Maker P.S. Case No. 126/15.
