The petitioner seeks bail in a case instituted for the offence under Section 20/22 of N.D.P.S. Act.

It is alleged that 600 grams of ganja has been recovered from the Gungti allegedly belonging to this petitioner. It is submitted that as per Government Notification, up to 1 kg. of ganja will come under small quantity. The maximum punishment of holding small quantity is up to six months, or with fine, which may extend to 10,000/- rupees or with both in terms of Section 20 of NDPS Act. It has been stated that the petitioner is in custody since 04.11.2016. Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on

Patna High Court Cr.Misc. No.866 of 2017 (2) dt.12-01-2017 2/2 furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Patna in connection with Special Case No.84 of 2016 arising out of Barh P.S. Case No. 358 of 2016, subject to the condition that both the bailors will be the close relative of the petitioner.
