JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 19-08-2015 Heard learned counsel for the petitioner and learned counsel for the State.

The present application under section 438 of the Code of Criminal Procedure has been filed seeking anticipatory bail in connection with Kangali P.S. Case No. 50 of 2013 registered under section 302 read with 34 of the Indian Penal Code.

It is contended that the petitioner is neither named in the FIR nor any cogent material has come against him during investigation.

Learned counsel for the State has opposed the prayer for bail. He submits that the accused persons who have been

He has further contended that the petitioner is evading arrest and after taking all coercive steps in order to secure his attendance, he has been declared absconder.

Regard being had to the serious nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for bail is rejected. (Ashwani Kumar Singh, J) Md.S./- U T
