Petitioner seeks bail in Chakiya P.S. Case No.151 of 2014 instituted for the offence under Section(s) 121, 121A, 124A, 427, 307, 120-B Indian Penal Code, Section 3⁄4 of Prevention of Damage to Public Property Act, Section 3⁄4 of the Explosive Substance Act, Section 16 and 17 of the Unlawful Activities (Prevention) Act, 1967, Section 17 of the Criminal Law Amendment Act, 1908, and Sections 150, 151, and 152 of the Railways Act, 1989.
Counsel for the petitioner submits that there is general and omnibus allegation against the petitioner that he along with other accused was involved in blowing railway track.
Patna High Court Cr.Misc. No.63434 of 2018 (2) dt.12-10-2018 2/2 It has further been submitted that other accused persons have been granted bail by different co-ordinate Benches of this Court.
Petitioner is in custody since 15.07.2018.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, XIII, Motihari, East Champaran, in connection with Chakiya P.S. Case No.151 of 2014, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) JA/- U T
