Learned counsel appearing on behalf of the State informs this Court that Executive Engineer, Minor Irrigation Division, Nawada, respondent no. 3 has informed that all the payments as admitted in the counter affidavit and supplementary counter affidavit has been credited into the account of the petitioner.

Considering the submission made on behalf of the State and informed by the Executive Engineer, Minor Irrigation Division, Nawada, the present writ petition is disposed of with a direction to the Controlling Officer of the petitioner to verify from the record as to whether the payments have actually been credited into the account of the petitioner, and if not at all, the petitioner will file representation for any other dues. The same may be granted to the petitioner in accordance with law within a period of six weeks.

4. In case, the statement upon instruction of the Executive Engineer, Minor Irrigation Division, Nawada, regarding retiral dues has been credited into the account of the petitioner is found to be incorrect and misleading, then in that case certainly the Court will initiate suo motu contempt against the Executive Engineer, Minor Irrigation Division, Nawada and the concerned Officer.
