JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 420, 406, 380, 323 and 34 of the Indian Penal Code.
Heard learned counsel for the petitioners.
It has been submitted on behalf of the petitioners that they are son-in-law and daughter of the informant and allegation is that they along with other accused persons have taken one of the daughter of the informant and admitted her in the mental hospital. All the allegations against the petitioners are general in nature and petitioners are in no way concerned with the aforesaid allegation. The case has been lodged after delay of about eight days.
Patna High Court Cr.Misc. No.10864 of 2017 (3) dt.28-03-2017 2/2 Heard learned A.P.P. as also learned counsel for the informant and they have opposed the prayer for bail. Having heard both sides, in view of the facts and circumstances of the case and also considering that petitioners are son-in-law and daughter of the informant, let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Patna, in connection with G.R. no. 6149 of 2016 arising out of Patliputra P.S. Case no.
301 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioners shall cooperate in the investigation and make themselves available before the police as and when required.
