JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2018 Petitioner prays for bail in connection with Special Case No. 16A/18, arising out of Bihta P.S.Case No. 69 of 2018, registered for the offences punishable under Sections 366, 376 (g) of the Indian Penal Code and Sections 3, 8 & 12 of POCSO Act.

Allegation against the petitioner is of kidnapping of minor daughter of the informant and is of committing rape upon her.

Submission of learned counsel for the petitioner is that the statement of the informant is contrary to the statement of the victim girl recorded under Section 164 Cr.P.C. and as a matter of fact she was a consenting party and when she came to know about the first marriage of the petitioner the present case has been lodged. Further submission is that another case of rape has also been lodged by the sister of the informant, that shows false implication of the petitioner and he is in custody since 13.6.2018.

Patna High Court Cr.Misc. No.65481 of 2018(2) dt.22-11-2018 2/2 Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail stating that allegations of kidnapping and rape are against the petitioner and prayer for bail of one co-accused Ranjeet Kumar has been rejected by a co-ordinate Bench of this Court vide order dated 23.8.2018 passed in Cr.Misc.No.45851 of 2018. Having heard the parties and in the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner.

However, since the petitioner is in custody, learned court below is directed to expedite the commitment of the case and thereafter learned trial court is directed to expedite the trial. Needless to say that petitioner and other co-accused persons shall co-operate in disposal of trial.

With the above observation, this application is dismissed.
