1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302, 494, 201 and 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

3. The informant alleges that his daughter was married with Manoj Thakur and out of the wedlock two children were born, it is further alleged that on account of nonfulfillment of dowry demand of Rs. 1,00,000/- and a motorcycle, Manoj Thakur performed second marriage with

Patna High Court CR. MISC. No.23408 of 2023(2) dt.14-07-2023 2/3 petitioner no. 3, it is next alleged that six named accused persons including the petitioners killed his daughter and disposed of the dead body.

4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that the marriage was solemnized fifteen years ago but no case was ever instituted either by the informant or the deceased in those fifteen years which amply demonstrates that the relationship between the deceased and her husband was cordial. It is further submitted that the deceased had gone to the clinic of Dr. Ganesh Prasad Singh and from there she went missing, it is also submitted that petitioners are father-in-law, mother-in-law and second wife of Manoj. It is next submitted that Manoj was taken into custody and he was granted the privilege of Regular Bail by order dated 10.05.2023 in Cr. Misc. No. 71889 of 2022.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on

No.23408 of 2023(2) dt.14-07-2023 3/3 anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Baruraj P.S. Case No. 70 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
