2. The petitioner seeks bail, who is in custody since 24.11.2022 in connection with Kaluahi P.S. Case No. 228 of 2022, S.Tr. No.465 of 2023, F.I.R. dated 20.11.2022 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 302, 120(B) of IPC.

3. Earlier the prayer for bail of the petitioner was rejected twice vide orders dated 10.08.2023 and 26.04.2024 passed in Cr. Misc. Nos.40951 of 2023 and 23809 of 2024 respectively.

4. Learned counsel appearing for the petitioner

Patna High Court CR. MISC. No.19670 of 2025(4) dt.20-06-2025 2/3 submits that the petitioner has falsely been implicated in the present case. The allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR. Petitioner is in custody since 24.11.2022 and the trial is not in progress.

Learned APP for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner and submits that there is direct and specific allegation against the petitioner that he has assaulted to the uncle of the informant by means of knife due to which the uncle of the informant sustained injuries and later on he died.

6. Vide order dated 18.04.2025, a report was called for with regard to the stage of the trial. Report of the learned Trial Court dated 26.04.2025 reveals that all the prosecution witnesses have been examined and now the case is pending for examination of all the defence witnesses.

7. Considering the allegation as alleged in the FIR as well as report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Kaluahi P.S. Case No. 228 of 2022, S.Tr. No.465 of 2023 pending in the court of learned Addl. Sessions Judge-V, Madhubani.

8. Prayer is refused.
