JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section-384 of the Indian Penal Code, u/S 17 of CLA Act and u/Ss 13, 16, 18 of the U.P. Act.
Four persons were arrested in connection with Hilsa P.S. Case No. 550 of 2015 and they disclosed that they had assembled to make preparation for committing murder of the informant of the present case as well as others. The aforesaid persons disclosed the name of the petitioner. No doubt, the petitioner does have criminal antecedent of several cases but submission on behalf of petitioner
Patna High Court Cr.Misc. No.42532 of 2016 (3) dt.25-11-2016 2/2 is that when the petitioner was remanded in Hilsa P.S. Case No. 550 of 2015, police remanded the petitioner in several other cases, in which, the petitioner had not been named. Moreover, coaccused Amit Kumar in whose confessional statement, the name of the petitioner surfaced, has already been granted privilege of bail by a coordinate bench of this court vide order dated 17-092016 passed in Cr. Misc. No. 32766 of 2016. Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Hilsa P.S. Case No. 547 of 2015 to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda.
