Earlier prayer for bail of the petitioner was rejected by this court taking note of his previous conduct but a liberty was given to the petitioner to renew his prayer for bail if, his trial is not concluded within 7 months.
The trial court has reported that the case of the petitioner has been committed to the court of Sessions on 15-102016 meaning thereby the trial of the petitioner has still not commenced.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each
Patna High Court Cr.Misc. No.41785 of 2016 (3) dt.26-10-2016 2/2 in connection with Azamnagar P.S. Case No. 59 of 2002 to the satisfaction of Sri D. K. Roy, learned Judicial Magistrate-Ist Class, Katihar subject to condition that the petitioner shall attend the trial court, in person on each and every date for a period of six months or till conclusion of his trial, whichever is earlier and if, he fails to do so on two consecutive dates without any reasonable cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner.
