Petitioner apprehends his arrest in connection with Didarganj P.S. Case No. 5 of 2017 registered under Sections30(a), 36 Excise Act. Learned counsel for the petitioner submits that petitioner has been implicated in this case falsely on basis of confessional statement of co-accused. Perusal of the seizure list shows that recovery has been made from other co-accused and nothing has been recovered from the conscious possession of this petitioner.
Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or
Patna High Court Cr.Misc. No.8430 of 2017 (2) dt.28-02-2017 2/2 surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City, Patna in connection with Didarganj P.S. Case No. 5 of 2017 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
