This application for regular bail arises out of Darbhanga Town P.S. Case No. 68/2017 for the offences under Sections 354/354(A) and 354(B) of the Indian Penal Code. Learned counsel for the petitioner has submitted that the criminal case has been lodged maliciously because of the dispute of drainage between the parties, who are agnates. He has submitted, referring to the First Information Report, that evidently there are cases pending between the parties. He also contends that the offence alleged is highly improbable, which is said to have taken place near public hand-pump, which is used for general public.

I find substance in submission made on behalf of the petitioner. Accordingly, this application is allowed.
