Petitioner is in jail custody since 20.01.2020 in Kasim Bazar P.S. Case No. 184 of 2019 registered for the offences punishable under Sections 25(1-b) A, 25(1-AA), 26, 35 of the Arms Act.
One country made carbine and 30 cartridges were recovered from the house of co-accused Deepak Mandal and Sima Devi. The above stated co-accused persons disclosed that petitioner had given recovered carbine and cartridges to them. Para 3 of the petition goes to show that petitioner does
Patna High Court CR. MISC. No.20561 of 2020(2) dt.31-08-2020 2/2 have criminal antecedent of altogether seven cases. Submission on behalf of the petitioner is that name of petitioner came in this case on the basis of exculpatory statement of co-accused persons and so far as criminal antecedent of the petitioner is concerned, out of seven cases, petitioner has already been acquitted in four cases and moreover, in the present case, except exculpatory statement of co-accused persons, there is nothing against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger in connection with Kasim Bazar P.S. Case No. 184 of 2019.
