====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-06-2023 Heard learned counsels for the petitioner and the State.

Petitioner apprehends arrest in a case registered for the offences punishable under Sections 341, 342, 354(b), 354(C), 376/511 of the Indian Penal Code, Sections 66E, 67A of the Information Technology Act and Sections 4, 6 and 8 of the Protection of Children from Sexual Offences Act. As per prosecution case, all the F.I.R. named accused persons including this petitioner tried to outrage the modesty of daughter of the informant and assaulted her by means of fists and slaps. It is further alleged that co-accused namely, Lal Singh took obscene pictures and videos of her and later, made it viral. Learned counsel appearing for the petitioner submits

Patna High Court CR. MISC. No.20861 of 2023(2) dt.28-06-2023 2/2 that specific accusation of attempting to commit sexual assault is against co-accused Lal Singh and petitioner is only alleged to caught hold of the victim. It is next submitted that F.I.R. has been lodged after delay of three days without any plausible explanation. Petitioner has got clean antecedent and has been made accused due to previous enmity.

Considering the nature of accusation and facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that the above named petitioner in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge (POCSO) Darbhanga, in connection with Mahila P. S. Case No. 67 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
