NILU AGRAWAL ORAL ORDER 09-09-2015 Heard learned counsel for the petitioner Sri Udai Chand Prasad and learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Kumarkhand P. S. Case no. 22 of 2015 for the offence alleged under Section 366(A) of the Indian Penal Code. The prosecution case is that daughter of the informant, namely, Jyoti Kumari, went out to ease herself. The allegation is that while she was returning, the petitioner along with others kidnapped her. When informant and others went to the house of the petitioner to enquire whereabouts of her daughter, they were assaulted by the petitioner and his family members. It has been submitted by the learned counsel for the petitioner that on the statement under Section 164 of the Code of Criminal Procedure the victim girl, namely, Jyoti Kumari, has not supported the case lodged by the informant, her mother, and it is stated that she has married the petitioner on 17.2.2015 and is living as husband and wife. Under such circumstances, let petitioner, namely, Navin |Ram, in the event of his arrest or surrender before the court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhepura, in connection with Kumarkhand P. S. Case no. 22 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
