Mr. Sanjay Kumar Tiwary, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 24-06-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 379, 427, 308, 504, 506/34 of the Indian Penal Code. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioner No. 1 is a woman and the informant alleges that on 28.03.2022 at about 9:00 am the petitioners took away the paddy crops of the informant and on protest the petitioners abused and assaulted him by means of danda, bricks and stones and when his wife and son came to save him they were also assaulted. The learned counsel for the petitioners submits that

No.20480 of 2023(2) dt.24-06-2023 2/2 the petitioners have been falsely implicated in the present case , it is next submitted on account of dispute related to land the present false case has been instituted alleging that assault had taken place when only altercation took place between both the sides, it is next submitted that petitioners are agnates and there is no injury report available on record.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Chandan P.S. Case No. 64 of 2022 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
