The petitioner seeks bail in connection with Sugauli P.S. Case No. 145 of 2018, registered under Sections 379 and 414 of the Indian Penal Code.
Learned counsel for the petitioner submits that regarding the theft of motorcycle from the door of the informant, Kanhaiya Sharma @ Kanhai Lal Sharma, Sugauli P.S. Case No. 145 of 2018, registered under Sections 379 of the Indian Penal Code against unknown and in course of investigation, the Police got recorded the confessional statement of Md. Farman in connection with Sugauli P.S. Case No. 127 of 2018 in which he showed his involvement in the present case disclosing the name of one Sipahi Kumar and the
Patna High Court Cr.Misc. No.62516 of 2018(2) dt.08-10-2018 2/2 petitioner, later on, the theft motorcycle of the present case recovered from the house of Sipahi. Thereafter, the petitioner has been remanded in the said case and in the present case, the petitioner is in custody since 11.05.2018, except the confessional statement of co-accused Md. Farman no incriminating material has been collected by the I.O either in the present case or any other case.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Motihari East Champaran in connection with Sugauli P.S. Case No. 145 of 2018, subject to the condition that one of the bailors must be parents/close relative of the petitioner.
