The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 324, 325, 307, 384, 379, 506 of the Indian Penal Code.
The prosecution case is that Mukund Ram came and took some article wroth Rs.1,000/- from the shop of the informant without payment, on protest being made, Mukund Ram inflicted injury with knife on the head of the informant. When son and wife came to rescue, then this petitioner assaulted the son and wife of the informant. The accused persons took away cash Rs. 5,000/- and articles worth Rs. 50,000/- from the shop of the informant. It is submitted by the learned counsel for the
Patna High Court Cr.Misc. No.38743 of 2015 (2) dt.29-09-2015 petitioner that petitioner is agnate of the informant. The injury has been found to be simple in nature. The petitioner's side lodged a case on 02.07.2014 for the same occurrence, whereas the present case was lodged on 05.07.2014 for the occurrence of 02.07.2014. There is Title Suit No. 486 of 2013 pending between the parties. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj in connection with Gopalganj (Town) P.S. Case No. 276 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
