JUSTICE SUDHIR SINGH ORAL ORDER 30-09-2015 Heard learned counsel for the petitioner and learned counsel for the State The petitioner is apprehending his arrest in connection with Barharia P.S. Case No. 30 of 2015 for the offences instituted under Sections 420, 406, 467, 468 and 471/34 of the IPC. The prosecution story, in brief, is that the main accusation against the petitioner and others is of committing the offence of cheating with the informant by taking Rs. 95,000/- by giving false assurance to send the informant's brother to abroad for job and also of giving forged ticket and forged Viza to the informant in furtherance of the cheating.
It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted
Patna High Court Cr.Misc. No.39660 of 2015 (2) dt.30-09-2015 2/2 that there is no document to show that the informant was ever detained at the Delhi Airport. Other co-accused has been granted anticipatory bail by this Court vide Cr. Misc. No. 21471/2015. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of four weeks from today in connection with Barharia P.S. Case No. 30/2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
