2. The petitioner seeks regular bail for the offence punishable in connection with S.Tr. No.84 of 2024 arising out of Dumraon P.S. Case No.294 of 2023 lodged under Sections 147, 148, 149, 323, 324, 307 and 302 of the IPC.
3. Learned counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 31.08.2024 passed in Cr. Misc. No.55030 of 2024 with direction to the trial court to expedite the trial. He further submits that in the bail application, there were 2 petitioners moved before this Court namely, Zafar Ansari and Imamuddin Ansari. Counsel further submits that in the FIR, informant has
Patna High Court CR. MISC. No.21013 of 2025(3) dt.20-06-2025 2/3 alleged against both the petitioners to attach by garasa on the neck and back side due to which brother of the informant died.
4. Learned counsel for the petitioner further submits that charge has been framed in this case and examination of prosecution witnesses started. He further submits that informant has deposed her evidence as PW2. He further submits that in the cross-examination, particularly paragraph 19, she has alleged that attack has been made on the neck by accused, namely, Imammuddin Ansari.
5. Counsel further submits that the specific allegation is against the present petitioner that he has attacked on the neck, and therefore, he may be released on bail.
6. Counsel further submits that petitioner's antecedent is clean and he is in custody since 19.07.2023.
7. Learned counsel for the State opposes the prayer for bail and submits that evidence of informant is attached and from paragraph 19 of the same, the specific allegation of attack on the neck, is against co-accused, Imamuddin Ansari.
8. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of
Patna High Court CR. MISC. No.21013 of 2025(3) dt.20-06-2025 3/3 the BNSS, 2023 to the satisfaction of District and Addl. Sessions Judge-XI, Buxar in connection with S.Tr.
