JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 341/307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner is that for dispute and panchaity relating to partition of property the petitioner fired from his pistol causing injury at the left hand of the son of the informant.

Submission is that the petitioner is in custody since 20.06.2016.

Considering the nature of alleged act as well as the period already undergone by the petitioner, he is directed to be

Patna High Court Cr.Misc. No.46682 of 2016 (3) dt.19-12-2016 2/2 released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya/Successor Court, in connection with Paraiya P.S. Case No.58 of 2016.
