JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-04-2017 The petitioner is apprehending his arrest in connection with Shambhuganj P.S. Case No. 156 of 2016, registered for offences punishable under Sections 379/411 Indian Penal Code. It has been submitted on behalf of the petitioner that allegation against the petitioner that he was carrying the sand on his truck without having valid challan, however, it has been submitted that petitioner had the valid challan and had shown the same to police also but the police did not accept the said challan and implicated the petitioner in this case with ulterior motive. Heard learned A.P.P. and learned counsel for mines department. They have not controverted the veracity of the said challan, which is annexed as annexure-2, with this application.

Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Banka in connection with Shambhuganj P.S. Case No. 156 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Vinod Kumar Sinha, J) sunil/- U T
