JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 04-08-2022 Learned counsel for the petitioner is permitted to remove defect (s), as pointed out by the office, if any, within a period of four weeks on resumption of physical mode. Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under section 395 of the Indian Penal Code.

As per the prosecution case, five unknown miscreants entered the bank in question, whereafter they looted cash amount to the tune of Rs. 2,38,000/- on the point of pistol. Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in

Learned counsel for the petitioner has further submitted that the petitioner is not named in the FIR and the name of the petitioner has sprung up in the confessional statement of co-accused Amit Kumar @ Vickey Kumar. Nothing has been recovered from the conscious possession of the petitioner. The petitioner is also accused in two other criminal cases which was lodged on the same day and prior to the said case, the petitioner has no criminal antecedent. Learned counsel for the petitioner has further submitted that co-accused person has already been granted bail by a Coordinate Bench of this Court vide order dated 10.03.2022 passed in Cr. Misc. No. 44873 of 2021. The petitioner is in custody since 01.05.2021. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-14th, Bhojpur at Ara, in connection with Sessions Trial No. 209/2021 arising out of Ara Mufassil P.S. Case No. 103 of 2021, with a condition that the petitioner is directed to remain physically present before the
