Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks regular bail in connection with Chandi P.S. Case No. 115 of 2018 registered on 01.10.2018 lodged under Sections 304(B), 201 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that vide order dated 03.08.2022, passed in Cr. Misc. No. 22256 of 2022 in regular bail application of the petitioner was rejected. Counsel for the petitioner submits that petitioner is in custody since 17.09.2021 and till date one and a half years have passed but charge has not been framed in this case.
Patna High Court CR. MISC. No.22984 of 2023(3) dt.21-06-2023 2/2 Learned counsel for the State opposes the prayer for bail.
A progress report has been called for in this case, by which it transpires that cognizance has taken place on 05.04.2023 under Sections 304(B), 201 and 34 of the Indian Penal Code, Police Paper has been served upon the counsel concerned on 19.04.2023 and case has been committed to the Court of Sessions on 28.04.2023.
In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner.
With this observation, the bail application stands rejected.
