The petitioner seeks bail in Madhuban P.S. Case No. 145 of 2018, registered under Sections 3,4,5,6,7 and 8 of the Immoral Traffic Act, 1956.

The police upon information are said to have raided the house of co-accused Binda Devi, whereafter three men and three women were found in objectionable condition including this petitioner. Males so apprehended disclosed that said Binda Devi had indulged in immoral trafficking by providing space for such activities in lieu of which she used to take heavy amount.

Learned counsel appearing on behalf of the petitioner contends that it is not clear from the First Information Report

Patna High Court Cr.Misc. No.62068 of 2018(2) dt.08-10-2018 2/2 as to who disclosed such facts to the police that the place was being used for immoral trafficking. The allegation in the First Information Report to this effect is vague, he contends. Considering the above noted submission and the fact that there is no allegation that there has been any transaction of money or any other item between the petitioner and any other female, this application is allowed.

Let the petitioner above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-Iv, Motihari, East Champaran in Madhuban P.S. Case No. 145 of 2018.
