The Petitioners apprehend their arrest in Ben P.S. Case No.159 of 2016 instituted for the offence under Section(s) 341, 323, 504, 379, 447, 307/34 Indian Penal Code pending in the Court of the Chief Judicial Magistrate, Nalanda at Biharsharif. There is allegation against these petitioners that they along with other accused persons assaulted the informant with lathi, danda and iron rod on his head causing head injury with intention to kill.
Case diary has been received. Injury report is available in the case diary.
The doctor has found injury on head, which is of
Patna High Court Cr.Misc. No.9654 of 2017 (4) dt.11-04-2017 2/2 size 3' x 1' x 1⁄2' muscle deep. The doctor opined that the patient's life was in danger and the patient was unconscious and had vomited due to Injury No.1.
Taking into consideration the injury sustained by the informant, this Court does not find it a fit case for grant of anticipatory bail.
Prayer is rejected.
The petitioners may surrender before the Court below and seek regular bail, which shall be considered and disposed of on its own merit without being prejudiced by this order.
