By the impugned order the learned trial court has directed the petitioner to pay the arrears as well as current rent to the Respondent.

Learned counsel for the petitioner submits that the petitioner is tenant and the suit for eviction has been filed by the Respondent/landlord on the ground of personal necessity in the year 2016. However, there is no pleading in the plaint regarding the arrears and current rent but the Plaintiff-Respondent filed a petition dated 31.7.2019 for payment of arrears as well as current rent which has been allowed.

I have heard learned counsel for the petitioner and perused the impugned order.

Patna High Court C.Misc. No.214 of 2022(2) dt.30-06-2022 2/2 It appears that relationship of landlord and tenant is admitted between the parties as well as the last rent paid. In view of the aforesaid, I do not find any illegality in the impugned order.
